      Breach Scab Act.
      Herbert L. Stedman, as manager of St. Helen's station, was charged, on the information of G. and W. Balfour, sheepfarmers of the Lydon station, with committing a breach of the Act by not giving them notice when mustering his flock.

      The prosecutors applied to the Bench to be allowed to withdraw the present information, and to have a fresh one laid by the Inspector, as they considered it was his duty under the Act to lay all informations.

      This the Bench overruled, as they considered it was open to any person to lay an information. The information was, by the sanction of the Bench, withdrawn.

      Breach Scab Act.
      Herbert L. Stedman, as manager of St. Helen's station, was again charged on the information of Inspector Busley, with having allowed fifty-eight sheep infected with scab to stray on land the property of George Rutherford, Esq., Leslie Hills.

      Mr. Inwood appeared for the defendent.

      Inspector Rusley stated that the present information was laid from instructions received from Mr. Rutherford, that the St. Helen's flock was held under an infected license, and that the brands given at the time the certificate was granted was HL conjoined on the fleece.

      W. O. Rutherford, manager of the Leslie Hills station, stated that he found the sheep in quesiton straying on a portion of his father's freehold property, which adjoins the Leslie Hills estate, and is situated on the banks of the Hanmer risver, and is not enclosed; that the sheep found straying bore the fleece brands described by the inspector.

      Mr Inwood pointed out to the Bench that the information was wrongly worded; that it stated "the sheep had strayed on land not in the lawful occupation of the defendent," this he maintained was not within the knowledge of the inspector at the time he laid the informaiton. An agreement entered into between he Count de Lapasture and George Rutherford, Esq., dated 1866, was put in, Counsel contended by that agreement that defendent was entitled to the right of commoage over the land on which his sheep had strayed. This the Bench overruled, and the witness Rutherford stated that the agreement now produced had been rescinded some time ago, and that the defendent's right (if any) to allow his sheep to stray on any protion of his father's freehold estate under that agreement had ceased. Council contended the the agreement was still in operation until the document was produced rescinding the.

      Defendent was fined 5s per head (£14 10s) and costs, 9s.

      Notice of appeal was given.

      Herbert L. Stedman, as manager of St. Helen's station, was further charged with allowing sixteen sheep infected with scab, to stray on land the property of George Rutherford, Esq., Leslie Hills.

      The evidence in this case and the argument of counsel were similar as in the previous conviction.

      Defendent was fined 5s per head (£4) and costs 6s 6d.

      Notice of appeal was given.
