    Court:
    PORT WAIKATO.

    An inquest was held on the 26th February, at the Court-house, before Major James Speedy, J.P. and Acting-Coroner for the district, to inquire into the origin of • fire at > certain house known by the same of the Harbour Hotel, the property of James B. Steedman. Mr. Detective Crick was present to watch the proceedings on behalf of the insurance companies at whose instance an inquiry was instituted.

    James Bramwell Steedman, sworn, said : I am an engineer, and proprietor of the Harbour Hotel, Port Waikato. On the morning of the 10th instant, at an early hour, I was aroused by some one calling me by my name in a very despairing voice. I jumped out of bed and rushed to the front door, on opening which I observed a large flame issue from the bowling-alley. I then ran to the back premises to get some water, and, while passing through my house, I called to my wife to get up and take the children out. I saw John Lindsay at the back-door when I opened it. He was the man who had been calling. I filled a bucket with water, and ran to where I thought the fire was, and threw the water upon it, and so continued doing until the fire was extinguished. Lindsay and I took a tub of water round to the outside to where the fire broke out. I told Lindsay to continue throwing water upon it in case it should break out again. I went and routed my my neighbour Mr. Fleming, and told him of the circumstances, and invited him to look at the place, I dressed myself. I then got a lantern, and Mr. Fleming and I got under the house to see if we could discover the origin of the fire. We found the remains of a case which smelt very strongly of kerosene oil. I took the remains of the box inside, and preserved it. I then proposed to Mr. Fleming that we should take a turn round the settlement and see if we could discover anything. We first went to the militia store on the wharf, where I knew or supposed the man in charge of the new steamer was stationed. I first saw Mr. Dashwood. It was about halfpast 2 o'clock a.m. I asked him if he had seen my house on fire, or any person passing. He replied he had not. He (Mr. Dashwood) said that he came down about 1 o'olook with Mr. Shillito from Mr. Williams's public house, and one or two others. Then I asked the watchman of the boat. He replied, No. We then went to the workmen's quarters. Woke the men up, and inquired if they had heard or seen anybody during the night. They all replied they had not, nor knew anything about the fire. We then took a good look round, but saw no person. Came back to my house, and Lindsay and I sat up watching till daylight in case the fire should break out again.

    By the Coroner : I went to bed between 10 and 11, and I think Lindsay a little before me. I am insured in the Royal Insurance Company for £400 —  being for house, stock, and furniture. I wrote to the office after the fire occurred. There appeared to be some shavings left near or in the box which was on fire. There were no shavings about my premises. The box could not have been about my house, as the remains appeared much cleaner than any I had.

    By detective Crick : The case was similar to those in which we get wines and spirits. The place had evidently been set on fire from the outside, as it had not done much harm inside. One party, Ralph Pennell, told me that he saw some flames and sparks, but thought it was the steamer. I asked him what he was doing up at that time, and he replied that bt was looking for matches, but could not find any. The portion of the case now produced is the Bame that wai found under my house.

    Lillias Steedman, sworn, said : l am wife to Mr. Steedman, proprietor of the Harbour Hotel, Port Waikato. [This -witness's evidence corroborated her husband's testimony.]

    John Lindsay, sworn, said : I am an able seaman, at present staying at Mr. Steedman's Hotel, Port Waikato. I was awakened, half-choked with smoke, I believe on Sunday morning, about three Sundays ago. I jumped up and gave the alarm, by singing out "Fire!" I could not get any answer. I then ran to the bar-door, and tried to burst it open. A few minutes afterwards I heard some one running along the passage. I opened the back-door, and fetched a tub of water round, and Mr. Steedman and I threw it over the top of the bowling-alley floor, so that the water should run on to the fire that had broken out. I continued throwing water upon the fire from buckets, which I fetched from the river.

    By Coroner : I believe the place had been set on fire, because a case was found, partly burnt, smelling i very strongly with kerosene oil. The case was underneath the bowling-alley. Two or three pieces of wood, half burnt, were picked up next day. I nearer saw any wood like these pieces about the premises before the fire.

    By detective Crick : I had no conversation, with anyone about the fire, nor did I hear any remarks. I had some talk with Ralph Pennell afterwards, and he said he had seen a light on that night, but he thought it was on board the new steamer. Any person could have seen the flames from the outside, as they were very high for a short time.

    The case in Court looks very much like the one taken from under the burning floor, and which smelt very strongly of kerosene at the time. I have not seen any cases so small about Mr. Steedman's premises lately. There was a large case lying out on the road, close to the house, which I sat on the evening before. I have never seen any cases under the bowling-alley;

    By a juror : I left Pearce's house about ten o'clock, and went to bed a little after. I struok a match to light the candle, but I put it out before I Wy down. There was no one in the bar when I got home, and no person outside. It was raining very hard. I cannot say if Mr. Steedman was in bed before me.

    By detective Crick : I was perfectly sober going to bed. l am not in the habit of smoking in bed.

    By a juror : I put out the candle with my fingers.

    Andrew Fleming, sworn, said: l am a storekeeper, residing at Port Waikato. I remember the morning of tbe 10th instant. I was awoke by Mr. Steedman about 2 o'clock, who stated that his houae had been set on fire, and asked me to come down as quickly as I could. Mr. Steedman appeared in a very excited state at the time, almost crying. He left, and I dressed myself and went to Mr. Steedman's house, I and was shown the place that was on fire by Mr. Steedman. He (Mr. Steedman) and Lindsay were the only parties I saw at that time. We got a light, and Mr. Steedman and I went round to see if the fire was all out. Mr. Steedman pulled out part of a case burnt, which, smelt very strongly of kerosine oil at that time. It appeared like a case that spirits and cordials would be packed in. We then took a walk down to the Government yard, to see if any person was about. At that hour we saw Mr. Dashwood, but I did not hear what passed between Mr. Steedman and him, as I stood outside by the door. We then went to the sleeping quarters, and woke them. Mr. Steedman told them that his house had been let on fire, and asked whether they had seen any person about during the night. They replied No, they had not. We then walked through the Tillage, but saw nothing to arouse suspicion.

    By the Coroner : I can swear that the case now produced is the same one taken by Mr. Steedman from under his house. I saw cinders or charred embers, but nothing to attract my attention but the box.

    By detective Crick : I was at Mr. Steedman's home on Sunday, the day of the fire. There were a number of men, one of whom said he saw a blaze and sparks. I think I asked him why he gave no alarm. He mid when he first saw it it appeared to be on board the steamer, but on looking a second time he saw it was nearly out, and did not think it worth his while. I have myself been threatened with arson, but it was a soldier when the troops were here. l am quite of opinion that the fire was by design. Mr. Steedman had nothing on but his night-shirt when he came to me, which was after he had put the fire out. The fire was out when I got there. Mr. Steedman must have exerted himself very much to put it out so soon.



    By a juror : It was a wet stormy night.

    William Basset Williams, sworn, said: I am proprietor of the Waikato Hotel. I remember the night of the fire at Mr. Steedman's. It was last Sunday fortnight. It was a very wet dirty night —  blowing hard. I allowed my watch-dog to come into the bar. I went to bed about 12 o'clock, and had been to sleep some time, when I was awoke by the dog barking and growling, and was obliged to turn him out, he was making such a noise. I had been asleep again, when he awoke me. Mr. Dashwood told me on Sunday morning, between seven j and eight o'clock, that some one had tried to set fire to Mr. Steedman's house the night before. I went down to look at it about nine o'clock the same day, and I thought there was not the slightest doubt of it being done maliciously.

    By Coroner : The dog will not bark unless some person or cattle are passing, but the night was too rough for cattle. The dog might bave been barking ' at Mr. Steedman and Mr. Fleming passing.

    By detective Crick : The case in Court is, to the best of my belief, the one I saw in Mr. Steedman's bowling-alley. I only saw a few cinders under the house. The reason I put the dog in the bar was in consequence of the night being so boisterous ; I had no house for him. I have not heard anything remarked that would throw a light on this affair.

    Henry Shillito, sworn, said : I am a storekeeper, residing at Port Waikato. I know nothing whatever about the fire at Mr. Steedman's. I heard there was one there between Saturday night and Sunday morning, the 9th and 10th instant. I saw a notice offering a reward of £15, but nothing of the writing on the back. I may have seen the original notice, but cannot say. (Notice produced.)

    By Coroner : I have no opinion of any importance as to the origin of the fire, and heard bo penon make any remark about the writing on the back of the notice now before the Court.

    By detective Crick : I will swear positively that it is not my handwriting. I cannot state who wrote it, as I do not know the handwriting. I have had no conversation of any moment on the subject. I was at Williams at half-past 11 o'clock on the Saturday night, and afterwards with Mr. Dashwood, who came with me to my own store, and remained there till half- past one am. (Sunday). He left, and 1 went to bed, being weary. 1 undressed myself, and went to bed, and got up on Sunday morning about half-past fa.m. I then came to Mr. Williams and heard from him about the fire. I got a •< nobbier" and went back. I did not go to see the place that had been on fire. After breakfast, Mr. Williams told me that a box with tea-tree shavings, &c , had been put under the house. It was reported at the time that it was a kerosine case, but the remains of the case now before the Court is not a kerosene case.

    By Coroner ; There is no bad feeling existing between me and Mr. Steedman, at least on my side. We have, as far as I know, been on friendly terms. I kept the store of Mr. Simpson when Mr. Steedman wrote about spirits being sold at his store., but I never spoke to Mr. Steedman about it. It is now a long time ago.

    Ralph Pennell, being duly sworn, stated : I am a baker in the employ of Mr. Shillito, I remember a fire taking place at Mr. Steedman's on Saturday night fortnight or Sunday morning following. Between 2 and 3 o'clock on Sunday morning, I got up to look for a match. I looked through the window of my bedroom and saw a large light, which I thought was on the steamer. I went into the other room to look for a match, but could not find one. On returning to my bedroom, I again looked through the window, but could see no light. I then went to bed and slept till half .past 7 u'u^ui/K, *l wliibli time I got up. I weab orer to the carpenter's shop for some shavings to light my fire. I heard John Lindsay say that Mr. Steedman's house had been set on fire. I told I had seen a large light, which I thought was on board the steamer. I heard no more about it until I came down to the Post-office, about 8 o'clock j and, in company with George Taylor, went over to see the place that had been on fire. Mr. Steedman came out at the time we were standing there. I told him that I had seen a very large light, as if sparks were flying. He (Mr. Steedman) asked me why I did not come down and tell him about it. I told him the light was out when I looked through the window the second time. We went inside, and Mr. Steedman showed me the remains of a case which he said had been under the house. He said he knew the case. I then left, and heard no more about it. I know no more.

    By the Coroner : It was a very wet blowy night. I could not swear to the case produced. The one Mr. Steedman showed me seemed larger. It might be the same. I took up the case at Mr. Steedman's, and smelt it. It smelt like burnt deal wood, but not of kerosine. I did not get wet that night, but lay wife was frightened that the roof would blow off our place, which was the reason I was up at the hour stated. I did not think when I saw the light that it was a house on fire. I thought there might be a big light for the men on board the steamer to enable them to look after her, as it was blowing so hard. I have known oakum and tar barrels burnt in the dockyard when men were working at night. l am not aware that a light is usually kept on board the steamer. Mr. Dashwood told some of the workmen on Sunday morning, in my hearing, that he had a light on the wharf on Saturday night. Mr. Shillito packs eggs and other articles in cases to send away. There are no small cases. None of the cases are of the same size as the one now in Court.

    By Mr. Crick : I have vied cases for lighting my fire, principally kerosine, but there are none there now. I use kerosine in my own house. I have not found any leakage of kerosene in any of the cases.

    By a Juror : I went to bed at half-patt nine o'clock, and was not towards Steedman's on that night. I went home from the Btore, and went to bed. I did not afterwards leave the house that night.

    By the Coroner : The light I saw at first seemed like a torch-light, and had disappeared in about a minute. It was not a minute from the time I first saw till it disappeared ; there were sparks with the flames. I live about 100 yards from Mr. Shillito. I left the store about eight o'clock ; it was raining then. I can see the lower part of Mr. Steedman's bar-door from my bed-room window.

    By Mr. Crick : I do not know the writing on the back of the notice. (Produced.) I neither read or write myself. I know Mr. Shillito's writing ; this is not it, he writes clearer. I know it is not his writing by some crooks in it. I cannot swear that it is not Shillito's writing. It is nothing like his usual writing in his books. I have never heard any remarks to me that Steedman set fire to his own house.

    John Henry Dashwood, sworn, said : l am a shipwright employed in the Steam Transport Service. I knew nothing of the fire at Mr. Steedman's, till told by Mr. Steedman that his house had been set on fire during the night. Mr. Fleming also told me about 6 o'clock on Sunday morning, the 10th instant. There was a man on duty, and I also attended myself, according to instructions from the Superintendent. The last person I saw on Saturday night was Mr. Shillito, who was in the Government store with me. We left Williams's (Waikato Hotel) at 11 o'clock, and about half-past 12 I went over to his store with him, and remained till about half.past 1 o'clock. There was a, masthead light on board the steamer. It had a reflector. I have known oakum, pitch, and tar used for a light when the men are working at night. There have been no such fires since Mr. Lodder has been superintendent. The light used on the night alluded to was an oil-light, and placed on the wharf in a line with the ship's bows. There was a candle in the office.

    By the Coroner : I left the Government office with Mr. Shillito at half-past 12 o'clock, and left his store at half- past 1 o'clock. I saw no person while with Mr. Shillito.     The jury, having consulted, the following verdict was returned, viz;:— " That, on or about Saturday night, the 9th of February, 1867 some person or persons, unknown to the jurors, did feloniously and maliciously set fire to the said house, with intent then and there to injure the said Jamei Bramwell Steedman. The jury is of opinion that James Branwell Steedman deserves great credit for the energetic manner he exercised in stopping the progress of the fire."
